Terms and Conditions of Purchase

1. Identification of the provider
The provider of the services described in these terms is RC Coaching and Mentorship LLC, EIN 39-3823560, with registered address at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, United States, operating under the trade name Escuela de Entrenadores Digitales (hereinafter, "the Provider").

2. Purpose and description of the services
The Provider sells business training and mentoring programmes aimed at professionals in personal training, nutrition and physiotherapy.

Not included: one-to-one consulting outside the scheduled sessions; tax, legal, employment or accounting advice; execution by the Provider of the client's content, advertising or sales; or technical support unrelated to the programme content.
3. Purchase process
The purchase is made at a distance, by telephone, and follows this process:
- The client requests information through the website form or another channel made available.
- An assessment call takes place to analyse whether the programme fits the client's situation.
- If it does, the Provider gives the client all the pre-contractual information: identity of the provider, characteristics of the service, total price including taxes, payment options and schedule, duration, start date and the conditions of the right of withdrawal.
- The Provider sends the client the offer and these terms on a durable medium, by email.
- The contract is only concluded when the client accepts the offer in writing, by electronic signature or express confirmation by email, and makes the first payment.
- The Provider sends confirmation of the purchase and, where applicable, the signed contract, on a durable medium.
Purchase initiated by the Provider. Where it is the Provider who contacts the client by telephone on its own initiative to offer a programme, the client will not be bound until they have accepted the offer in writing or sent their consent on a durable medium. Verbal acceptance during the call is not enough to conclude the contract.
4. Prices and payment methods
The prices of each programme are communicated to the client before purchase and include all applicable taxes. There are no additional charges that have not been disclosed beforehand.
Accepted payment methods: credit or debit card, bank transfer and split payment in monthly instalments. Where the split payment is arranged through a financial institution, such as Sequra Worldwide, S.A. for clients resident in Spain, its conditions are shown to the client before confirming.
The split payment may have a higher total amount than the single payment. In DESPIERTA, the single payment is €1,200 and the split payment €1,500. The difference is disclosed before purchase and there are no other costs or added charges.
5. Duration, schedule and start of the service
Each edition has a start and end date communicated to the client before purchase. All students in the same edition start together.
If the client purchases once admission to the current edition has closed, their access is reserved for the next available edition, unless expressly agreed otherwise.
The client's inability to attend certain sessions does not give the right to an extension or financial compensation, without prejudice to the sessions being recorded and available.
6. Client obligations
- Provide truthful data and keep it up to date.
- Attend the live sessions or watch the recordings when unable to attend.
- Complete the tasks and submissions within the stated deadlines.
- Make proper use of the platform, the community and the resources.
- Treat the team and the other participants with respect.
- Refrain from spreading offensive, discriminatory or defamatory content, and from spamming or unauthorised self-promotion within the community.
Serious and repeated breach of these obligations, after written notice and a reasonable period to remedy it, may lead to suspension of access to the community, without prejudice to the client's right to receive the rest of the service purchased.
7. Support guarantee
In the DESPIERTA programme, if at the end of the 12 weeks the client has completed all the tasks properly and on time and has not reached their first €2,000 in revenue, they will keep, at no additional cost, access to the community, the materials and question support through the official channels until they reach that goal.
This guarantee consists of an extension of the support and does not constitute a promise or a forecast of financial results. Results depend on each client's starting point, market, niche and level of execution.
The extension is limited to access to the community, the materials and question support, and does not include new live sessions or resources other than those originally provided for.
8. Non-payment
If any instalment is not paid, the Provider will notify the client and give them fifteen calendar days to settle the situation.
If that period passes without the situation being settled, the Provider may suspend access to the platform and the community until the outstanding amount is paid, and claim the amounts owed together with the applicable statutory late-payment interest.
Where the payment has been split through a financial institution, collection of the instalments is managed by that institution in accordance with the conditions accepted by the client when arranging the financing.
9. Right of withdrawal
A client who purchases as a consumer has a right of withdrawal under the terms set out in the refund and withdrawal policy, accessible from the footer of this website and forming an integral part of these terms.
10. Intellectual property
Purchasing any of the programmes grants the client a personal, non-transferable and non-exclusive licence to use the content for training and non-commercial purposes, limited to the duration of the access purchased.
Reproducing, distributing, publicly communicating, recording, assigning or selling the content, or using it to develop similar products or training, is prohibited without the express written authorisation of the Provider.
11. Use of image and testimonials
Live sessions are recorded so that students can watch them later. A client who takes part in them consents to that recording for that purpose.
Using the client's image, voice, name or results for promotional purposes requires their express and specific consent, which they may revoke at any time by writing to the contact address, with no retroactive effect on material already published.
12. Termination of the contract
The contract may be terminated by mutual agreement, by exercising the right of withdrawal within the deadline, by serious breach by either party not remedied after a written request, or by non-payment under the terms of clause 8.
If the termination is attributable to the Provider, it will refund the amounts corresponding to the part of the service not provided.
13. Force majeure
If, due to force majeure beyond the Provider's control, it is not possible to hold a session on the scheduled date, it will be rescheduled or replaced by an equivalent format, ensuring in all cases the full provision of the service purchased.
14. Customer service and complaints
The client can send any question or complaint to hola@coachingmentorishiprc.com or to the phone number +34 697 70 31 33, Monday to Friday from 09:00 to 20:00 (Spain (peninsular) time). The Provider will acknowledge receipt and reply in writing.
15. Applicable law and jurisdiction
These terms are governed by Spanish and European Union law insofar as it applies to clients resident in the European Union.
The consumer will in all cases retain the protection granted by the mandatory provisions of their country of habitual residence, and may bring proceedings before the courts of that country.
